Terms & Conditions

Purpose of the App

At Motiv, we believe the #1 thing stopping you from meeting your health and wellness goals isn't a lack of information or ability - it's a lack of accountability. Our app facilitates wellness challenges and competitions to help users achieve their goals and:


  • Hit more steps daily
  • Run further distances
  • Spend more time achieving wellness goals


Our app facilitates wellness challenges and competitions to help users achieve goals related to metrics like steps and walking/running distance.

Rules

  • Cheating of any kind is strictly prohibited.  Users proven to be cheating or engaging in nefarious behavior will have their accounts suspended or terminated immediately
  • Other illegal activities, including money laundering or other fraudulent behavior, are strictly prohibited
  • Data is only logged or considered part of the challenge if it is logged in the source system.  For example, steps not recorded via Apple Health will not count towards the challenge
  • Users are restricted to one account per person only
  • Challenges exceeding $100 per person will not be allowed
  • 10% transaction fees will be deducted from the total pot as a service fee prior to final payout(s)

Eligibility and Restrictions

 To use the app, users must:

  • Be 18 years or older
  • Provide Name, Email, &  Date of Birth (DoB) during sign-up and complete Know Your Customer (KYC) requirements
    • Users may need to provide government verified identification if initial KYC checks fail
  • Pass geolocation checks, proving you are in a country/state where we operate
    • Currently, gameplay is only allowed in the United States, excluding the following states: Alaska, Arkansas, Connecticut, Delaware, Hawaii, Louisiana, Montana, South Carolina, South Dakota, Tennessee
  • Fund their accounts to participate in challenges
  • Grant permissions for the app to access location data or Apple Health data or data from other sources, depending on the challenge type.

Users earning over $600 annually will be provided a 1099 form for tax purposes

Currently, our app only supports iPhones, with plans to expand to other devices in the future.

Data Refresh Policy

  • Currently, user data only refreshes when users open and reload the app
  • Users are granted a three (3) day grace period after a challenge ends to refresh their data
  • If no participant refreshes their data within this timeframe, the contest will be forfeited, and all funds refunded.
  • If some participants refresh their data and others do not, only users with refreshed data will be considered for the final standings or payout
  • Similarly, for individual challenges - users will be given a 3 day grace period to load data before considering whether you have or have not met your goal.
  • If you load your data after one day, the challenge will be settled at that time (win or lose).
  • If you do not load your data for 3 days, we will use the latest data we have to determine whether or not you met your goal.  Refunds will not be provided for users who fail to load their data before a challenge is settled

Data Collection and Usage

Motiv stores only the minimum necessary data required to determine whether users meet their goals or their standing within a challenge. Data is retrieved only for the duration of the competition (e.g., if a challenge runs from 12/1 to 12/31, only data from those dates is accessed). Data accuracy depends on the source (e.g., Apple Health). If the source lacks data (e.g., the device is turned off), the app cannot supplement it.

Motiv does not directly store user banking or card info.

Security, Privacy, and Legal / Regulatory Compliance

At Motiv, users are our number one priority.  We take the following steps to ensure the highest levels of customer satisfaction:

  • Secure and protect user data in compliance with local and national security, privacy, legal, and regulatory laws and standards.
  • Follow all requirements set by integration partners, such as Apple Health, to ensure proper and ethical use of APIs.


 Motiv is committed to operating within the bounds of all relevant laws and regulations, ensuring a secure, trustworthy, and ‘compliant-by-default’ platform for users. Given the app’s structure, which involves peer-to-peer transactions, user health data integration, and challenge-based incentives, Motiv  is careful to address the following key areas: 

  • Compliance with applicable laws & regulations
  • Compliant integration with payment provider
  • Focus on Anti-Money Laundering (AML), Know Your Customer (KYC), and anti-fraud procedures
  • Compliance with all requirements for third party integrations (e.g., Apple Health)
  • Security & privacy for all users and their data


Motiv will reduce its attack surface to the minimum necessary by reducing the amount of user health or funds data it stores.   Data that is stored will be done so in full alignment with applicable security & privacy requirements and regulations. 

Refunds & Disputes

 To ensure high quality gameplay, we provide customers the opportunity to dispute challenge outcomes and request refunds as appropriate.

Refunds will be triggered automatically for the following reasons:

  • The challenge is forfeited due to lack of complete data from all participants (minus transaction fees)
  • The inviting user cancels the challenge before it is accepted
  • Both users in an active challenge agree to nullify an ongoing challenge (not yet available)

Refunds may be requested for the following reasons:

  • Proven technical issues with the application that prevent proper data recording, challenge completion, or accurate payouts
  • Other disputes deemed to be valid after a case-by-case review

Refunds will NOT be provided for the following reasons:

  • A user failed to refresh their data before the grace period was over
  • User falls to properly log activity directly into the data source (e.g., Apple Health - phone was off) 
  • A user accidentally submit an incorrect $ amount during challenge creation (these challenges should be canceled)

Disputes may be submitted to request refunds via the Settings page directly through the Motiv mobile application.

We strive to acknowledge all customer disputes within 72 hours and communicate resolution or denial of disputes within 14 business days.  Where applicable, refunds will be issued to users via the original payment method within 7-10 business days

Changes to Terms

These terms may be updated periodically. Continued use of the app after changes indicates acceptance of the revised terms.

Responsible Gaming Policy

 Motiv is designed to promote wellness, accountability, and personal growth through challenges that encourage healthy behaviors. While certain features of the app involve financial stakes, Motiv is not a gambling platform and supports games of skill (not games of chance).

To ensure responsible participation:

  • Eligibility: Users must be 18+ and located in the United States (excluding Arkansas, Connecticut, Delaware, Louisiana, Montana, South Carolina, South Dakota, and Tennessee) to participate in any challenges involving financial commitments.
  • Spending Limits: No single challenge may exceed $100 per person. Users are encouraged to participate only at levels they are comfortable with
  • No Credit or Loans: Motiv does not offer credit, loans, or any form of wagering on borrowed funds.
  • Wellness Over Winnings: Motiv is built to drive personal accountability over financial gain. All challenges are based on measurable goals, not chance.
  • User Safeguards: Users may deactivate their account at any time by reaching out to info@yourmotiv.com. Motiv reserves the right to restrict participation to maintain the health and integrity of the platform.
  • Support Resources: If you or someone you know is struggling with compulsive use of the platform, please contact us at info@yourmotiv.com. We can assist or connect you with wellness resources.

Privacy Policy

 

1. Information We Collect

We collect the following categories of personal information:


Personal Information Provided by You

  • Email
  • Name
  • Address
  • Date of Birth
  • Payment and banking information (for deposits, withdrawals, and challenge participation)

Health and Wellness Data

  • Apple Health data (e.g., steps, distance, screen time, sleep metrics)
  • Only data within the boundaries of an active challenge period is collected and stored

Geolocation Data

  • For compliance and eligibility verification purposes 

Usage Data

  • Device type, app interactions, IP address, and analytics on feature usage (non-identifiable)


2. How We Use Your Information

We use your information to:

  • Facilitate user registration and account creation
  • Verify your identity and location (KYC and geolocation)
  • Process deposits and withdrawals
  • Administer and score challenge participation
  • Ensure fair play and prevent fraud
  • Provide customer support
  • Comply with legal obligations
  • Improve app features, usability, and performance

We do not use health data for advertising or marketing purposes



3. How We Share Your Information

We share your information only when necessary:

  • With service providers (e.g., payment processors, geolocation and KYC providers)
  • With integration partners (e.g., Apple Health, for data authorization)
  • With regulators or legal authorities, if required by law
  • Between users, limited to challenge results and public-facing performance if explicitly allowed by challenge settings


We do not sell your personal information.



4. Data Retention

We retain your personal and challenge data only as long as needed:

  • Challenge data is retained only within the bounds of the active challenge period and up to 3 days after
  • KYC and payment data is retained per legal requirements (e.g., for financial reporting)

Data is deleted or anonymized when no longer required.



5. Data Security

We use appropriate administrative, technical, and physical safeguards to:

  • Encrypt sensitive information in transit and at rest
  • Restrict access to authorized personnel
  • Monitor systems for unauthorized access

We minimize the attack surface by only storing what is strictly necessary for challenge validation and compliance


6. Your Rights and Choices

Depending on your location, you may have the right to:

  • Access a copy of your personal data
  • Correct or update your information
  • Delete your data
  • Withdraw consent for health or location data collection
  • Lodge a complaint with your local data protection authority

7. Children’s Privacy

Motiv is intended for users aged 18 and over. We do not knowingly collect data from anyone under the age of 18. If we learn that we have inadvertently collected such data, we will delete it immediately


8. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes by email or through the app. Please review this page periodically for updates
